Terms of service

Welcome to Nuvia.

These Terms of Service set out the rules for accessing and using the Nuvia website and the services offered through it.

By browsing our site or making a purchase, you acknowledge that you've read these Terms of Service, as well as, where applicable, our Terms of Sale, Privacy Policy, and Return & Refund Policy.

Nothing in these Terms limits any mandatory consumer protections you're entitled to under the laws of your own country or state.

1. Site Publisher

The Nuvia site is operated by the operator of the Nuvia store. For any question, contact us at: contact@feelnuvia.com

2. Purpose of These Terms

These Terms of Service cover: access to the Nuvia site, use of its features, browsing our products, creating a customer account (where applicable), placing and tracking orders, use of content on the site, and the relationship between Nuvia and site users. Purchase-specific terms are detailed in our Terms of Sale.

3. Capacity to Use Our Services

To place an order, you must have the legal capacity to enter into a contract, or be properly represented where the law requires it. By using our site and placing an order, you confirm you are legally able to enter into the corresponding contract.

4. Product Information

Nuvia aims to present the essential features of its products clearly before purchase. Photos, illustrations, videos, and lifestyle shots aim to represent products as accurately as possible; slight differences in appearance may still occur depending on your screen, lighting, or color perception. The essential characteristics of the product actually sold are those stated on its product page.

5. Price

Prices shown on the site at the time of order apply, displayed in the currency shown at checkout. Any shipping or other applicable fees are communicated before final checkout. Nuvia may change prices for future orders; a later price change does not affect an order already confirmed.

6. Orders

Before confirming an order, the customer can review the selected products and pricing/delivery information. Final order confirmation carries an obligation to pay, clearly indicated before you confirm.

After checkout and payment, a confirmation is sent to the email address provided. The customer is responsible for the accuracy of the information provided when ordering, including email address, delivery address, and contact details.

7. Order Refusal or Cancellation

Nuvia may, within the limits allowed by law, decline or cancel an order for a legitimate reason, including: payment declined or not completed, reasonable suspicion of fraud, clearly abusive use of the site, exceptional product unavailability, or a practical inability to fulfill the order. Where a paid order is cancelled by Nuvia with no delivery taking place, the corresponding amount is refunded.

8. Payment

Available payment methods are shown at checkout. Transactions may be processed by secure third-party payment providers. Nuvia may wait for payment confirmation before preparing or shipping an order. The customer agrees to use only a payment method they are authorized to use.

9. Product Availability

Products are offered while stocks last. If a product becomes unavailable after an order is confirmed, Nuvia will notify the customer as soon as possible and offer an appropriate solution, which may include a refund for the unavailable item.

10. Delivery

Delivery conditions, zones, fees, and timeframes are set out on the site and in our Shipping Policy. The customer must provide a delivery address that is sufficiently precise and accurate for the order to be delivered.

11. Returns

Return and refund conditions are set out in our Return & Refund Policy, including Nuvia's 30-day satisfaction guarantee.

12. Product Warranty

Products sold by Nuvia are covered by Nuvia's own commitments as described in our Return & Refund Policy. Beyond that, you may also be entitled to warranty protections under the consumer protection laws of your own country or state — nothing in these Terms is intended to limit or replace those rights.

13. Appropriate Product Use

Products must be used in line with their intended purpose, any instructions provided with the product, and precautions listed on the site or packaging. Nuvia is not liable for damage resulting exclusively from clearly inappropriate use, unauthorized modification, or installation that clearly disregards the instructions provided, subject to applicable mandatory legal provisions. This does not limit any rights you hold under applicable consumer protection or other legal regimes.

14. Prohibited Use of the Site

You agree not to use the Nuvia site for unlawful purposes or in ways that could harm the site, Nuvia, or third parties. This includes, in particular: attempting unauthorized access to the site's computer systems; introducing a virus, malware, or other harmful code; disrupting or attempting to disrupt the site's operation; using the site for fraudulent purposes; impersonating a third party; fraudulently collecting data about other users; or using Nuvia's content in violation of applicable intellectual property rights.

Nuvia may take reasonably necessary steps to protect its site and users in the event of fraudulent or clearly unlawful use.

15. Intellectual Property

Unless stated otherwise, elements belonging to Nuvia on the site — including its name and visual identity, logos, photographs, videos, illustrations, graphics, text, visual creations, and the site's overall presentation — are protected under applicable intellectual property law where legal conditions for protection are met. Any unauthorized reproduction, representation, adaptation, or use of protected content is prohibited, subject to exceptions provided by law.

16. Reviews, Comments & User-Submitted Content

Where the site allows users to post a review, comment, or other content, it must comply with applicable law and third-party rights. Content must not be fraudulent, defamatory, threatening, clearly unlawful, in violation of a third party's intellectual property rights, or intended to mislead other users. Nuvia may moderate or remove content where necessary to comply with the law, protect third-party rights, or ensure the normal operation of the service.

17. Third-Party Services and Links

Certain site features may be provided by third-party providers, including Shopify, payment providers, or carriers. The site may also contain links to third-party sites or services. When you leave the Nuvia site or directly use a third-party service, that third party's own terms and policies may apply. Nuvia is not responsible for the content of a third-party site it does not control, subject to any legal obligations that apply to it.

18. Site Availability

Nuvia strives to keep its site accessible and functional. Access may nonetheless be temporarily interrupted for maintenance, updates, technical issues, action by our hosting provider or another provider, or events beyond our control. Where reasonably possible, Nuvia works to limit the duration of such interruptions, but permanent, uninterrupted availability cannot be guaranteed.

19. Liability

Nothing in these Terms of Service should be interpreted as excluding or limiting a right or liability that cannot legally be excluded or limited. Nuvia remains responsible for its obligations as required by applicable law.

20. Force Majeure

Performance of certain obligations may be suspended where an event meets the legal conditions of force majeure under French law, which governs these Terms — broadly, an event outside a party's control that could not reasonably have been foreseen when the contract was formed and whose effects cannot be avoided through appropriate measures. The consequences of such an event are determined in accordance with applicable law.

21. Personal Data

Personal data collected through use of the site and orders is processed in accordance with our Privacy Policy, which sets out the data collected, its purposes, the legal basis for processing, retention periods, providers that may receive certain data, and user rights. We encourage you to review our Privacy Policy for full details.

22. Changes to These Terms

Nuvia may update these Terms of Service to reflect changes to the site, new services, changes to our operations, or changes in applicable law. The version that applies to an order is the one available to the customer at the time it's placed. The "last updated" date appears at the top of this document.

23. Governing Law

As Nuvia is operated by a France-based business, these Terms of Service are governed by French law. This does not deprive a consumer residing elsewhere of any mandatory protections they're entitled to under the law applicable to them.

24. Complaints & Consumer Mediation

If you have a concern about an order, please contact our customer service team first at: contact@feelnuvia.com — we'll aim to resolve it amicably.

For customers located in the European Union: French law entitles you to refer an unresolved dispute, free of charge, to a consumer mediator. Mediator contact details are available on request at contact@feelnuvia.com.

For customers located outside the European Union, including the United States: this specific mediation process is not available to you, but you're welcome to contact us directly, and you retain any right to bring a claim before a court with jurisdiction under the law applicable to you.
