Terms of sale
These Terms of Sale govern purchases made on the Nuvia website between Nuvia (the "Seller") and any individual purchasing for personal use (the "Customer").
By placing an order on the site, the Customer confirms they have had the opportunity to read these Terms of Sale before the contract is concluded.
Note: Nuvia is operated by a France-based business. These Terms are governed by French law (see Section 20), while nothing in them limits any mandatory consumer protections you're entitled to under the laws of your own country or state.
1. Seller Identity
The Nuvia site is operated by the operator of the Nuvia store.
Email: contact@feelnuvia.com
2. Purpose and Scope
These Terms set out the rights and obligations of Nuvia and its customers for the distance sale of products offered on the site, for orders placed by individual consumers. Business/wholesale orders may be subject to separate terms.
3. Products
Nuvia sells shower heads, filtration systems, replacement filters, and related accessories. Each product's key features are presented on its product page before purchase. We encourage Customers to review this information before buying.
We take care in presenting our products accurately. That said, color rendering, proportions, or materials may appear slightly different depending on your screen, lighting, or display settings. These visual differences do not change the essential characteristics of the product actually sold.
4. Availability
Products are offered for sale while stocks last. If a product becomes unexpectedly unavailable after an order is confirmed, Nuvia will inform the Customer as soon as possible. If an order cannot be fulfilled, the corresponding amount is refunded.
5. Price
Prices shown on the site at the time of order confirmation apply. Prices are displayed in the currency shown at checkout. Any shipping fees are shown separately before final checkout and payment.
Nuvia may change its prices at any time for future orders; any price change after an order is confirmed does not affect that order.
6. Placing an Order
The Customer selects the products they wish to buy and adds them to their cart. Before final checkout, the Customer can review the selected products, quantities, price, any discounts, shipping costs, delivery address, and total order amount, and can correct any errors before paying.
Final order confirmation carries an obligation to pay. The checkout button clearly indicates this before you confirm.
After checkout, the Customer receives an order confirmation at the email address provided. The Customer is responsible for the accuracy of the information provided when ordering.
7. Order Refusal or Cancellation
Nuvia may refuse or cancel an order for a legitimate reason, including: payment declined or not completed, clearly incorrect information, reasonable suspicion of fraud, fraudulent use of a payment method, product unavailability, or a legitimate inability to fulfill the order.
If an order that has already been charged cannot be fulfilled by Nuvia, the corresponding amount is refunded.
8. Payment
Payment is made using one of the payment methods offered at checkout. The Customer confirms they are authorized to use the selected payment method. Payments may be processed by secure third-party payment providers; Nuvia does not store full card details. The order is prepared and shipped after payment is confirmed.
9. Delivery
Products are delivered to the address provided by the Customer when ordering. Available shipping methods, costs, and estimated delivery times are shown before checkout and detailed in our Shipping Policy.
The Customer must provide a complete and accurate delivery address. If an address error is found after ordering, the Customer should contact Nuvia as soon as possible. Once a package has been handed to the carrier, an address change cannot always be guaranteed.
Transfer of risk: where the carrier is arranged by Nuvia, the risk of loss or damage to the product transfers to the Customer once they, or a third party they've designated, physically take possession of the item. Full delivery details are in our Shipping Policy.
10. Delayed or Missing Delivery
If your order is delayed, please refer to our Shipping Policy for the steps to take, including contacting our customer service team so we can look into your shipment.
11. Return & Refund
Nuvia offers a 30-day satisfaction guarantee on eligible products, giving Customers the option to return a product they're not satisfied with. Full conditions, timelines, and shipping-cost responsibility are set out in our Return & Refund Policy, which forms part of these Terms.
Nothing in this section limits any separate warranty rights described in Section 12 below.
12. Product Warranty
Nuvia stands behind the quality of its products. If a product you receive is defective, damaged in shipping, or doesn't match what you ordered, contact us at contact@feelnuvia.com with your order number, a description of the issue, and photos or video where possible — we'll make it right at no cost to you for return shipping.
Beyond Nuvia's own commitments, you may also be entitled to warranty protections under the consumer protection laws of your own country or state. Nothing in these Terms is intended to limit or replace those rights.
13. Product Use
The Customer should use products in line with their intended purpose, the instructions provided, any installation/care guidance, and the information on the product page. Nuvia is not liable for damage resulting exclusively from use that clearly disregards the instructions provided or the product's intended purpose. This does not limit any mandatory legal rights you hold under your own country's or state's law.
14. Liability
Nuvia is responsible for fulfilling its obligations under these Terms as required by applicable law. Nothing in these Terms removes or limits any right that the law of your country makes mandatorily available to you as a consumer.
15. Force Majeure
A party may not be held liable where performance of its obligations is prevented by an event legally recognized as force majeure under French law, which governs these Terms. The consequences of such an event are determined according to applicable law and whether the event is temporary or permanent.
16. Personal Data
In managing orders, Nuvia processes certain personal data belonging to its customers. Full details on the data collected, its purposes, retention period, recipients, any transfers, and the Customer's rights are set out in our Privacy Policy, which we encourage you to review before ordering.
17. Intellectual Property
Content belonging to Nuvia on the site — including photographs, videos, text, graphic elements, logos, visual creations, and brand identity elements — is protected under applicable intellectual property law where legal conditions are met. Unauthorized reproduction or use of protected Nuvia content is prohibited, subject to exceptions provided by law.
18. Record-Keeping
Where required by applicable regulation, Nuvia retains records of electronically concluded contracts and provides Customer access on request.
19. Customer Service & Complaints
For any question or complaint about an order, contact Nuvia at: contact@feelnuvia.com. To help us process your request faster, please include your order number.
20. Governing Law & Dispute Resolution
As Nuvia is operated by a France-based business, these Terms of Sale are governed by French law.
If you have a concern, we encourage you to contact us first so we can find a solution together. If a dispute cannot be resolved amicably, you retain any right to bring a claim before a competent court under the law applicable in your jurisdiction. Nothing in these Terms is intended to deprive you of any consumer protections you're entitled to where you live.
Note for EU customers: France's consumer mediation process (available to EU residents free of charge after a prior written complaint) is not available to customers located outside the European Union.
21. Changes to These Terms
Nuvia may update these Terms to reflect changes to its business, products or services, operations, or applicable law. The Terms that apply to an order are the version in effect at the time the order is placed. The "last updated" date appears at the top of this document.
